What services do you provide in Chile to help me purchase real estate and what do they cost?

Our major service is handling the legal related issues for property purchase in Chile, residency, after sales support such as construction consulting and hooking up utilities. If you should find a property on your own, we would still be happy to handle the legal work related to the purchase of a property in Chile.

Our legal service for the purchase of property in Chile include:

  • Helping negotiate final terms of the sale
  • Conducting a title search
  • Obtaining expropriation certificates
  • Checking that the property taxes are paid
  • Checking that there are no leans or mortgages on the property
  • Drafting the sales contract
  • Drafting of any special powers of attorney
  • Helping you obtain your Chilean IRS RUT number
  • Arranging for international bank transfers
  • Translations and explanation of all contracts and documents in to English, so you know what it is you are buying.

The title search is the most important step. It will tell you if their is any legal problems with the property or any possible claims against the property, and typically goes back 10 years. The statute of limitations is 10 years for anyone to bring a claim against a property in Chile. Many problems that are discovered in the title search are fixable. For example, a previous title did not get registered or the owner has to get another signature from a family member. Other problems can not be fixed, and the purchase should be abandoned. For example, it turns out that the owner really is not the owner or the property is about to be expropriated by the government.

In terms of Legal Fees and expenses once a property is located, we charge 2.0% plus expenses for properties with a final sale price of over $50,000,000 pesos, 2.5% for properties that sell for between $25,000,000-50,000,000 pesos, and 3.0% for properties that sell for under $25,000,000 pesos. We have a 500,000 pesos minimum charge (e.g. you get lucky and find a property that cost only a 1,000,000 pesos).

Expenses typically include such things as document fees, phone calls, title registration, and any travel expenses.

In terms of payments for purchase of a property, we require 1/3 of the projected legal fees plus expenses to start the title research on a property. When the research is complete, you are at the point where clients typically need to make a decision to go ahead with drafting the purchase agreement based on what was discovered in the title research. At that point we require another 1/3 payment plus any outstanding expenses.

The final 1/3 of the legal fees must be payed at the time of the signing of the purchase agreement and the title is registered. If you should decide not to go ahead with the purchase, you do not need to pay the final 1/3 fees. You only need to pay any outstanding expenses. We want to help give an exit strategy for clients when faced with a bad property deal.
